Terms of Service

1. Acceptance of Terms

By accessing or using Capitol Tracker (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

Capitol Tracker aggregates publicly available financial disclosure data — congressional stock trading disclosures, corporate insider Form 4 filings, and institutional 13F holdings reports — sourced from the U.S. Securities and Exchange Commission (SEC) EDGAR system and other public government disclosure sources. The Service presents this data for informational purposes. Capitol Tracker is operated by a sole trader based in New Zealand.

3. Not Investment Advice

Capitol Tracker is not a registered investment adviser, broker-dealer, or financial planner. Nothing on the Service constitutes financial, investment, legal, or tax advice, or a recommendation to buy, sell, or hold any security. You should not rely on the Service as the basis for any investment decision, and should consult a qualified professional before making financial decisions.

4. Data Accuracy Disclaimer

Data is sourced from public filings and third-party feeds and is provided "as is," without warranty of any kind, express or implied, including accuracy, completeness, or timeliness. Source filings occasionally contain errors, and our automated processing may occasionally misparse or misrepresent underlying data despite reasonable efforts to validate it. Capitol Tracker is not liable for any decisions made in reliance on data displayed on the Service, or for errors, omissions, or delays in that data.

5. Accounts

You must provide a valid email address to create an account. You are responsible for maintaining the confidentiality of your account access and for all activity under your account.

6. Subscriptions, Billing, and Cancellation

Certain features require a paid subscription ("Pro"), billed monthly through our payment processor, Stripe. By subscribing, you authorize recurring charges until you cancel. You may cancel at any time through the billing portal; cancellation takes effect at the end of the current billing period. Except where required by law, payments are non-refundable.

7. Acceptable Use

You agree not to:

  • use the Service for any unlawful purpose;
  • attempt to scrape, reverse-engineer, or systematically extract data from the Service beyond normal use;
  • interfere with or disrupt the Service's operation; or
  • use the Service to harass, defame, or impersonate any individual named in the underlying disclosure data.

8. Intellectual Property

The Service's design, code, and compiled/formatted presentation of data are owned by Capitol Tracker. The underlying government filing data itself is public information and not owned by Capitol Tracker.

9. Third-Party Services

The Service may link to or integrate with third-party platforms (including Discord) and relies on third-party infrastructure providers (including Supabase, Stripe, Vercel, and Resend). Capitol Tracker is not responsible for the content, policies, or practices of third-party services.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPITOL TRACKER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold Capitol Tracker harmless from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of New Zealand, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Service is subject to the exclusive jurisdiction of the courts of New Zealand.
